Underdeveloped Areas Financial Transfer Payment Legal Issues

As an important component of financial management system, transfer payment system involves the division of authority and fiscal power between different levels of government, and influences the realizations of citizens’survival rights, development rights and other basic rights and opportunities in different regions. Transfer payment system has important politic, economic and social implications in sustaining social stability, promoting balanced development among regions and so on. In the tax sharing system reform of1994, our country’s transfer payment system was established preliminarily, improving the central macro control ability, facilitating the sustainable and rapid economic growth, and maintaining the society stability. However, we still lack a specific law to regulate financial transfer payment scientifically, which results in loopholes existing in the procedure system and entity system of financial transfer payment, and seriously influences the efficiency of financial transfer payment function and the national policy objectives’achievement. In2012, the introduction of "Several Opinions about Supporting the Revitalization and Development of South Jiangxi and Other Former Central Soviet Area by the State Council", draws wide public concern. This document mentions that we should further strengthen the efforts of central balanced financial transfer payment, gradually reduce the gap of local standardized financial revenue and expenditure, and increase the central support of south Jiangxi and other former central soviet area. Based on the opportunity that the State Council revitalizes soviet area, combining economics, political science, jurisprudence and etc, and comprehensively utilizing comparative analysis, historical analysis, value analysis, empirical analysis and etc, this paper analyzes the basic theory of transfer payment, empirically investigates the current financial transfer payment situation of south Jiangxi, and analyzes the experiences of foreign financial transfer payment successful legislations and our country’s present situation of financial transfer payment legislation. This paper proposes some basic assumptions about perfecting our country’s legislation of financial transfer payment so that it can embark on a track of normalization and legalization as soon as possible, and solve the problems faced by our country, especially some underdeveloped areas (south Jiangxi and other former soviet areas) in the process of constructing socialism and harmonious society better.
