Study On The Project Legal Person Responsibility Organization Of Government Investment Project

The implement of unified project legal person responsibility, advance the process of the refinement, standardization, standardization and the informationization of China’s highway construction, and it has powered the process of realization of highway construction implementation leapfrog development goals. However, there are some problems such as no clear legal concept, the identification procedures are not standardized, qualification management is not clear and the assessment and supervision system is not perfect and so on in the practice of highway construction. In this paper, taking the government investment in highway construction project legal person responsibility organization as the object of study, carried out the research as follows:(1)The paper expounds the research background and significance of the project legal person organization. Based on the system theory and control theory and the use of project legal person responsibility and the background of the highway construction in the new period, the paper analysis the necessity and importance of the legal system to promote the project by project legal person system. Under the study of Standardized management of key highway construction projects, the paper investigates the implementation of the project legal person responsibility in Shaanxi, Shanxi, Hebei and Guangdong provinces by using the method of questionnaire investigation, discussion, site visits and other methods. In the premise of the establishment of the organization system, the paper established valuation model of project legal person execution evaluation. Combined with the practice of highway construction project, the paper introduces the methods and steps of evaluation method of highway construction project execution.Based on the system theory and control theory, combined with the practice of government investment project legal person management construction of highway, the paper researched on project legal person responsibility organization, enriched and improved the theory of project legal person management. The study promoted the implementation of the project legal person system, promote the process of highway construction project management standardization, standardization and refinement. And it also provides reference for improving the project legal person organization and execution.
