In recent years,with the rapid growth of China's economy,environmental pollution has become increasingly serious,the traditional model of environmental pollution control is not enough to solve our current environmental problems we are facing now.In order to improve the environmental quality and curb environmental pollution,a series of environmental protection measures have been formulated in the field of environmental protection in our country,and the third party pollution control has emerged as a new model of pollution control.Third party management of environmental pollution is a typical market-oriented pollution control mode,the introduction of the third party in the market of environmental pollution control of the main pollutant discharge enterprises to pay pollutants to third-party enterprises to professional management,so as to achieve a certain Pollution control effect.The implementation of third-party governance to improve corporate governance pollution,improve environmental quality,promote the development of environmental protection industry is of great significance.This paper summarizes the basic theories of the third party governance,such as the rise and development of environmental pollution,and analyzes the applicability of the third party governance theory.And through the introduction of specific cases to analyze the complexity of third-party governance legal responsibility.Although the legal liability of third party environmental pollution is an important part of China's environmental legal liability system,in view of the current third-party environmental pollution management development,system the main responsibility of environmental pollution third-party legal responsibility is not clear,the role of government is also not clear,there are also many other problems like regulatory system and financing system.This paper will also put forward innovative ideas on the third party governance legal liability system by studying the successful experience of the United States and Japan in the third party governance of environmental pollution and combining the basic national conditions of our country.First of all,improve the top design,clarify the main responsibility,distribute the corporate responsibility proportionately a balanced distribution of corporate responsibility,expand the scope of the main responsibility;Second,strengthen the policy guidance,change the government functions.Finally,strengthening government supervision effect,establish credit accumulation evaluation mechanism,completely credit supervision measures,construct the legal responsibility system of the third party governance,to guarantee the healthy development of the thirdparty management of environmental pollution and effect sufficiency lecture marketplace supervisor.
