Since the reform and opening up,China's economy and foreign trade has gained huge success,driving the maritime transport market and the rapid development of the port.But at the same time,China's ports have made a lot of pollution and damage.Soil,water,air and so on was damaged seriously in way of port.Port pollution has affected the port adjacent areas and industries,affecting the port city resident's life and tourism industry normal operation.The composition of the port media covering water,land and air,which makes the port pollution has a certain degree of particularity,that is easy to form cross-administrative region.There are many reasons which in charge of the port pollution,such as the history of planning errors,the unity of management mode(government & enterprise),the port of the rule of law is not a high level of port pollution directly and indirectly.With the increasing intensity of environmental governance in China,it is imminent to improve the level of harnessing pollution by law.The Fourth Plenary Session of the 18 th CPC Central Committee put forward the decision to promote the rule of law in an all-round way and pointed out that the ecological environment should be protected in a standardized,institutionalized and procedural way.China's port environmental pollution control should follow the requirements of the times to the rule of law to achieve port management.In our country,port environmental pollution control must strictly take scientific legislation,pay more attention to the law enforcement,the fair judicature and the entire people abide by the law "the new 16 Tips" guidelines as the instruction,create every opportunity,actively learn from the modernization high of port governance experience,the construction of the port in line with the actual situation of China environmental governance rule of law system.In the process of port environmental legalization,we need to take sustainable development as guiding and port modernization environmental protection with legal consciousness & rule of law.China's current green port construction,environmental protection,technology-greening provides some experiences.In the future,we should pay more attention in the field of legal and administrative system,strengthen the role of environmental justice in harbor environmental governance,pay special attention to the environmental law-abiding work of port enterprises.Eventually achieve port rule of law.And make new contribution in our country's economy and social development.
