Research On The Legal Regulation Of The Harm Caused By Personal Environment

With the socio-economic development,the main body of environmental pollution from the company,enterprises gradually to individuals.There is no complete legal system at home and abroad to regulate the personal environment.It is generally based on the objective reality of the development of a single line of laws or the use of litigation mechanism to deal with specific personal environmental damage behavior.This paper aims to clarify the concept of personal environmental damage behavior,and combined with China's environmental protection law,tort law and relevant laws and regulations and practice,analysis of the regulation of personal environmental damage behavior of the necessity and feasibility,while drawing on Germany,the United States on On the basis of the experience of personal environmental damage behavior,and provide reference for the construction of legal norms of personal environmental damage in China.This paper consists of four chapters:The first chapter the concept and classification of environmental damage caused by the behavior analysis,and analysis of the damage caused by the behavior regulation of the individual environmental law and economics foundation,the regulation of the necessity and the key factors of regulation;The second chapter is the analysis of the legislative status of dialysis and harmful behavior from the personal environment to examine two aspects of China through theoretical research on the harm behavior of individual environment analysis and analyzes the shortage of the existing laws and regulations,based on the concern about the problem of the status quo of our country,draw on the theory of the legitimacy is in line with the development trend of the times the conclusion.In the third chapter,the author makes an overseas investigation on the harm caused by the individual environment,and summarizes the experience of Germany and the United States on the issue.The fourth chapter from the individual environment caused by harmful behavior legislation,establish the legal security system and ideas,the introduction of foreign experience to improve the correction of the three aspects of the analysis of the present situation of personal environment in China caused by legal regulation and behavior.From three aspects,the author puts forward the opinion on the regulation of the individual environmental harm behavior,which has reference value.
