Research On The Legal Regulation Of Corporate Environmental Behavior In Overseas Investment

There are huge environmental risks in overseas investment,it is an important issue in China to reduce the investment environment risks in overseas investment by regulating the environmental behavior of overseas investment companies,maintain the investment interests of enterprises,maintain the environmental rights of the host country and reducing the environmental effects of overseas investment companies has a negative effect on the destruction of China's international image.Research on this issue,can guide the practice of overseas investment practice,and it's the proper meaning of sustainable development goals,practicing the green “One Belt,One Road” and promoting China's international image.In view of this,this paper is divided into the ensuing four parts:The introduction mainly expounds the research backgrounds,research significances,research trends at home and abroad,research contents,research methods,and innovations of this article.The first part combs the basic issues related to the legal regulation of enterprises' environmental behavior in overseas investment.This part defines the relevant concepts of legal regulations on environmental behavior of enterprises,clarify the meaning of corporate environmental behavior and legal regulation of corporate environmental behavior.On this basis,give the system legal analysis of the legal regulations on environmental behavior of enterprises from the following four levels: pollution transfer theory,corporate social responsibility theory,stakeholder theory,and the balance between the rights and obligations of investors and host countries,in addition discusses the necessity of strengthening the legal regulation of environmental behaviors of overseas investment enterprises.The second part is an analysis of the practical dilemma of legal regulation of environmental behavior of enterprises in overseas investment.The lack of environmental protection awareness and environmental protection responsibility,environmental information disclosure and insufficient public participation raise questions caused public doubts,insufficient response to the rule of law in the hostcountry and environmental compliance management,the joint action of these four factors has resulted in the practical dilemma of legal regulation of enterprises' environmental behavior in overseas investment.The third part is the analysis of the reasons for the insufficient legal regulation of environmental behavior of enterprises in overseas investment.Limited scope and role of international law regulation is the primary reason why it's difficult for enterprises' environmental behavior to be effectively regulated by law.Together with the host country has insufficient supervision on the environmental behavior of overseas investment enterprises,the lack of effective constraints on corporate environmental responsibility performance,insufficient guidance of the home country on the environmental behavior of enterprises,these leads to the lack of effective regulation of enterprises' environmental behavior in overseas investment ultimately,then overseas investment company were questioned to cause environmental pollution frequently.The fourth part is the thoughts on the legal regulation of environmental behavior of enterprises in overseas investment,based on the analysis and argumentation above.Adopting measures for improvement at the level of international law,strengthening the compliance of overseas investment enterprises to the rule of law in the host country,the guarantee mechanism of environmental behavior regulation of enterprises,improve domestic related safeguard mechanisms,I expectation to promote the construction and further improvement of the legal regulation of environmental behavior of enterprises in overseas investment,reduce the environmental risks of overseas investment companies and maintain their investment interests,safeguard the environmental rights of the host country,and improve China's international image of environmental protection.
