River Basin Ecological Compensation Legal System Construction Research

The rapid development of economy and the destruction of the environment have already announced an important signal to us,that is,we must not only Jinshan Yinshan mountain,but also qingshuiqingshan mountain.the situation that China's watershed ecological environment is facing is not optimistic.therefore,in order to promote economic development and environmental improvement,especially to protect the watershed ecological environment,we must actively promote the innovation of watershed ecological protection system,and studying the legal system of watershed ecological protection compensation provides the possibility to promote the innovation of watershed ecological protection compensation system.The compensation for watershed ecological protection is a system that aims at protecting the watershed ecological environment and adjusts the interests among the main bodies of watershed ecological environment protection by some means.Although the compensation for watershed ecological protection has achieved some success in practice,it also has some problems,such as imperfect legislation,unscientific compensation standards,inadequate supervision,lack of long-term effective mechanism,imperfect management system and imperfect related supporting systems.Combining with the domestic and foreign research theories of watershed ecological protection compensation,this paper introduces the concept,value objectives,theoretical basis,policies and laws of China's watershed ecological protection compensation,further analyzes some problems existing in China's watershed ecological protection compensation system,and puts forward corresponding countermeasures.at the same time,referring to the advanced experience of foreign watershed ecological protection compensation,this paper puts forward some legal suggestions on how to improve China's watershed ecological protection compensation legal system.For example,we should speed up the promulgation of the regulation on compensation for ecological protection,construct the litigation mechanism of compensation for ecological protection,improve the compensation model of ecological protection in the river basin,improve the accounting system of compensation standards for ecological protection in the river basin,establish the evaluation system of compensation for ecological protection in the river basin,and establish and improve the compensation management system and related supporting systems for ecological protection in the river basin.Thesesuggestions provide legal support for ensuring the orderly promotion of ecological protection compensation in the watershed,and are conducive to better safeguard the ecological environment in the watershed.
