Study On Legal Problems Of River Ecological Protection Compensation In Rural Areas Of China

Ecological protection compensation,as a powerful measure for the restoration and protection of the environment,has been widely used in aspects of forests,rivers,and land protection.River resources,as an important support for the survival and development of human beings,their ecological environment has been severely damaged during the long-term exploitation and utilization.Rivers in rural areas in China have a higher degree of natural state than urban rivers and are closely linked with villages.However,due to the lack of environmental protection awareness of the villagers,the lack of government environmental protection funds,serious pollution from agriculture,aquaculture,and industry,river pollution problems have become more severe.In this case,we need to pay attention to how to maintain the natural ecology of rivers,carry out ecological rehabilitation of polluted rivers,and enhance the effectiveness of compensation mechanisms for river ecological protection in rural areas.Constructing a complete legal system can provide institutional guarantee for the formulation and improvement of river ecological protection compensation policies,and play an important role in improving the overall environmental protection capacity of rural areas in our country.At present,the legal norms of river ecological protection compensation in China are faced with such problems as scattered distribution,low level of law,laws and regulations are not operational,lack of specific regulations and other issues.The application effect in rural areas is not very satisfactory.Foreign countries have rich classical cases of river ecological protection compensation.These cases provide us with rich practical exploration experience in terms of model selection,innovation of compensation subjects and compensation methods,strengthening of regional cooperation,and expansion of sources of compensation funds,and many of them are useful institutional experiences for us.Make full use of foreign experience,and make suggestions for river ecological protection compensation in rural areas of our country from the aspects of improving the legislative model and system,identifying the rights and obligations of the responsible party,expanding the sources of compensation funds and compensation initiation methods,establishing effective compensation standards,establishing a market-based compensation mechanism and completing relevant supporting measures and effect evaluation mechanism for ecological protection compensation,can accelerate the promotion of river ecologicalprotection environmental protection in rural areas in our country.
