Prevention And Control Of Environmental Noise Pollution Legal System Research In The City Of Our Country

Since the beginning of the industrial revolution,human society and science and technology have been changing with each passing day,and environmental pollution is becoming more and more serious.In the problem of environmental pollution,environmental noise pollution phenomenon is one of the phenomenon can not be ignored,and the air,water and solid waste pollution together as one of the four major pollution in the world,has seriously affected the interference to the public's health and quality of life,the environmental protection work will be listed as key control object the prevention and control of noise pollution,is a practical concern to contemporary people and future generations are living together the production and development of the realistic problem.Research on prevention and control of environmental noise pollution,improve the relevant laws and regulations,and the phenomenon of noise pollution in city environment has been effectively controlled,to give people living in a relatively quiet safety in the acoustic environment is right,through a series of measures to raise public awareness of environmental protection,so that people can set up the prevention and control of noise pollution and other hazards of the idea,on the other hand can also strengthen the public participation enthusiasm and participation,which will greatly improve the sound quality of the environment to the city,active prevention and treatment effect on noise pollution.In March 1997 the "People's Republic of China environmental noise pollution prevention law" formally implemented,this is a milepost type event for China's noise pollution prevention and control,prevention and control of environmental noise pollution marks a new starting point,has become the basis of China's environmental noise pollution prevention legal system.But from the law for 20 years,the rapid social development and the progress of science and technology leads to new problems emerge in an endless stream of environmental noise pollution,environmental noise pollution caused by the growing complaints and disputes prompted us to be aware of the need to have been behind the pace of the times in some ways to modify.This paper is divided into four parts:the first part mainly on the concept,the environmental noise pollution in the city of our country control the necessity and theoretical basis of China's current legislation and expounds the current situation of our country,environmental noise pollution prevention and control legal system of longitudinal introduction analysis;the second part is the investigation of the three countries of Germany,Japan and the United States city environmental noise pollution prevention law,in order to get the three points,so that our country can learn from its good points in further revise and improve the "noise pollution prevention and control law";the third part introduces the system through the reflection,the defects of China's current city environmental noise pollution prevention law,system design,and separately from the legislation,law enforcement and judicial perspective,finds out the deficiency of our existence,preparing for further improvement.The fourth part of the article is aiming at the shortage of previously excavated and the urgent need for improvement from three aspects puts forward some improvement suggestions,through the study of foreign excellent precedent system,combined with the actual situation of our country,to implement the Party Central Committee and the State Council on accelerating the decision of the construction of ecological civilization,based on the concept of development firmly innovation,harmony,green,open,sharing,more is to protect and improve people's living environment,improve the sound quality of the environment,to put forward the feasible suggestions and measures to prevention and control of noise pollution in China is not only the theoretical basis,but also have the strong operability.
