Research On Government Environmental Administrative Responsibility

In recent years,with the development of economy,environmental problems have become increasingly prominent,in order to alleviate the current severe environmental pollution,improve environmental quality,conscientiously implement the basic national policy of China's economic and social sustainable development,strengthen the environmental administrative responsibility of the government placed in a prominent position.However,the phenomenon of "government failure" still exists in our government's improper management or inaction in the field of environmental protection and management.The government is a modern serviceoriented government,for the benefit of all the people,and constantly improve the quality of public services,to achieve the maximization of social public interests,improve the quality of our environment,promote the harmonious unity of human and natural environment,the sustainable development is a modern service-oriented government's basic responsibility.Therefore,it is particularly important to correctly locate the responsibility of the government in the protection and management of the environment,and improve the government's ability to serve the environment.In this paper,through consulting and arranging a large number of information and documents related to the government's environmental administrative responsibility,this paper lays a solid theoretical foundation for the writing of this paper.First of all,the meaning of the administrative responsibilities of the government are defined,further analysis of the theoretical issues related to the new environmental law on the administrative responsibilities of the government,the government set up environmental administrative responsibility content etc..Secondly,the paper analyzes the problems existing in the environmental administrative responsibility of our government from the aspects of legislation,practice and accountability.Set the environmental administrative responsibility of our government is mainly manifested in three aspects: one is the environmental administrative responsibility for setting the principal is not clear,the two is the lack of cohesion in the setting of reasonable administrative responsibility and obligation specification standards on the issue,the three is to set the imbalance phenomenon in the field of environmental administrative subject and administrative environment the responsibility.In our country,the implementation of the government's environmental administrative responsibility mainly includes: the environmental supervision and management mechanism is not perfect,the function of the environmental management organization is obscure,and the funds of the environmental protection departments can not be independent.In our country,the question of the government's environmental administrative responsibility is mainly as follows: the government executive accountability is relatively weak,the lack of government legal accountability,the accountability of government accountability and so on.Again,based on the analysis summary of environmental administrative responsibility of our government has a series of problems on the basis of reference of developed countries is mainly successful cases in USA,Japan and Russia,the government in the legislative and administrative responsibility in environmental management,summarizing practical experience,combined with China's national characteristics,the countermeasures and suggestions to improve the environment the administrative responsibility of our government is put forward from the following aspects.The first one is to establish the set sound system of the administrative responsibilities of the government;including live: the main environmental administrative responsibility setting must be clear;norms and obligations of environmental administrative responsibility to achieve effective convergence;legal responsibility of environmental administrative subject should be set in details.In the second aspect,the social accountability mechanism should play a greater role in improving the government's environmental administrative responsibility.The main measures to live: first of all,the government environmental administrative responsibility of the main body of social accountability are clearly defined,followed by social accountability content and procedure should be standardized and legalized,the social accountability methods should be flexible,the social accountability results obviously.The last aspect is to strengthen the executive mechanism of the government's environmental administrative responsibility.Mainly: set up special environmental resource management organization,clear the functions and responsibilities of each department of environmental management,and implement the independent accounting mechanism of the environment management institution.
