The punishment power of teachers is an unavoidable and controversial topic in the field of education. The primary and secondary school students can't get rid of the influence of external factors because they are in the physical and psychological development period. Therefore, teachers help the students understand their wrong behaviors by punishment to correct them and cultivate healthy personalities. In order to promote the sustained and healthy development of the education in primary and secondary schools, teachers should exercise the punishment right reasonably and legally.However, as the advocate for the rights of students, many people have a misunderstanding of teachers' punishment power in reality. On the one hand, the prevalence of "appreciation education" makes many people think that teachers can only encourage and praise students in teaching management and abandon the "disciplinary education"; on the other hand, many people can not distinguish between "right discipline form", "corporal punishment" and "corporal punishment in disguised form". The confused understanding leads to many problems of exercising the right of discipline.This study, on the basis of previous studies, chooses the primary and secondary school teachers in D District as the research objects, adopts the method of empirical study and collects information by questionnaire survey and interview research to study the problem of the punishment power of teachers. The main structure of this paper is divided into three parts: firstly, on the basis of investigation, many problems are found in the process of exercising the right of punishment by analyzing the situation of the usage of punishment in primary and secondary schools in D District. Secondly, according to the existing problems of the punishment power of teachers in primary and secondary schools,it analyzes the factors of influencing the exercise of punishment power in a systematic way from the point of view of teachers, students and the objective environment. Lastly,in view of the existing problems, it puts forward some feasible suggestions from four aspects based on the foreign and previous studies: the teachers, the schools, the law and the public opinion.
