Research On The Perfect Judicial Safeguard System Of Human Rights In China

Human rights is a global issue in today's society. Human rights protection is the hot issue that people concern their self-interests on. Human rights is the basic rights that all people should have. It is the common goals that all people and all countries want and try to achieve.Since 21 st century, the system and theory of human rights are continuous improvement. “Human rights” has been written in the constitution, the five-year plan for national economic and social development and the articles of association of the communist party of China. At the 18 th National Congress of Communist Party of China in November 2012, “get the respect of human rights and guarantee” as important target content to build a well-off society in an all-round way. On November 9, 2013, the Third Plenary Session of the 18 th Central Committee of the Chinese Communist Party proposed China will conduct a comprehensive reform, and make "improve the system of judicial protection of human rights" as reform target in the plant. In addition, China has formulated the national human rights action plan. Under the background, we should further strengthen the judicial protection of human rights, and use judicial safeguard to protect human rights. Although our country has made human rights into the constitution, and how to use the judicial guarantee for human rights is particularly important. Whether the existing security system is perfect, if it suitable for the development of society, is an important standard evaluation of realization degree about human rights in China.The purpose of this paper is to study the judicial protection of human rights in our country. The first part of the paper is about the concepts of human rights. Nowadays many scholars have different idea about definition of human rights. We compare different issue to induce the universal definition of human rights. With the definition, we can get the relationship between human rights and law. Use basic knowledge of human rights can find the characteristic of judicial system of human rights and its international impact.The second part of article is about nowadays judicial safeguard of human rights in our society. According to analysis of the judicial system in our country, we can find the judicial safeguard of human rights in our daily judicial activities and summarizes the current situation of the judicial protection of human rights in our country.The third and last parts are about the lack of judicial protection of human rights in China. Depends on the all mentions, we should admit the achievements of the judicial protection of human rights in our country and find solutions of shortcomings.In this paper, by focusing on the development of human rights in our country and the implementation situation, find out the insufficient in human rights protection in our country, especially in the aspect of judicial protection of human rights, to solve the disadvantages. In the research of the shortage about judicial protection of human rights in China, find ways to improve the system of judicial protection. Try to achieve human rights through judicial activities.
