On The Plaintiff Qualification Of Citizen In Civil Public Interest Litigation

The fifty-fifth item of the newly revised civil procedure law has preliminary established our country's civil public interest litigation.This article strictly limits the scope of the plaintiffs main body of the civil public interest litigation system in China,The relevant organs and organizations concerned, which are limited to the law, but the individual citizen will be excluded. This paper studies the concept and origin of the civil public interest litigation, and compares the relevant provisions of the civil public interest litigation system outside countries and regions.By taking the method of comparative study, empirical research and systematic study, it points out the limitation of our current civil public interest litigation system, and demonstrates the importance of giving the citizen the plaintiff qualification of civil public interest litigation.And on the basis of absorbing the advanced legislative experience of foreign countries, combining with the national conditions of our country, the article gives suggestions to the construction of the civil public interest litigation supporting system.
