Research On American Matrimonial Torts

Along with the socialist concept of rule of law, People's Right-protection awareness has been more and more strong. Implementation of husband and wife shall have equal status in the marriage relationship. Safeguard the legitimate rights and interests of both sides of husband and wife has increasingly become the focus of scholars attention. Matrimonial tort is an important factor to connect marriage law and tort law. This author of the paper focuses on legal regulation, judicial relief and several aspects of research of American marital torts. We can find that both the method in a husband and wife marital tort law system building and the judicial practice belong to the world's advanced level. The method can provide perfection of Chinese family law and the domestic marital tort system construction provides valuable experience and enlightenment.The paper includes five parts.Part one “Introduction”: this part illustrates selected topic background and the significance of topic selection. Then introducing literature and scholars, mainly view analysis our country and the United States legal science research status quo of marital tort.Part two “The connotation of American Matrimonial Torts”: This part mainly analyze the cognizance of marital tort, and show the particularity of marital tort from four aspects.Part three “Main types of Matrimonial torts in U.S. Law”: Marital torts could be also divided into Matrimonial torts between Illustrates the marital tort between husband and wife, the third party interference the connotation of the marriage act in U.S. law. This part is the foundation of the fourth chapter.Part four “The status quo about Matrimonial torts legal institution in American Law”.The chapter mainly talk about the fate of marital torts in contemporary in American Law from the aspects of American justice, legislative.Part five The “conclusion” of this dissertation: Through the analysis of the method on marital tort,The author of the paper thinks American Marital tort includes two types: the marital tort between husband and wife, the third party interference connotation of marriage; China should draw lessons from the legislative and judicial, admitted to the third person indirectly interfere with the marriage act, However, China shouldn't accept alienation of affection with the third party interference such as adultery relationship behavior, build a reasonable system of marital tort institution.
