The mortgage of commercial housing is a kind of buying house which gets loans by set security for house. In present juridical practice, the failure of getting mortgage loans leads to a series of problems. This paper is mainly research on the influence of mortgage in commercial housing. In the case of buying commercial housing this paper discussed, the disputed focus is whether the failure of getting mortgage loans influenced the disputed house to handle to the buyer. Through analysis the factors which influenced the house given to the buyer then to identify the meaning of the failure of getting mortgage loans to judge whether it influence the house given to buyer. In this case Yang has the duty to manage the mortgage loans. Due to his failure of getting mortgage loans that is to say he hasn't fulfilled his duty. So the failure of getting mortgage loans influenced the disputed house given to the buyer. The award of this case showed that whether manage the mortgage loans doesn't influenced the given of the disputed house. However this award doesn't exactly correct due to the meaning of the mortgage loans is to help the house-buyer to purchase the money he ought to give the house seller.
