In the current economic downward pressure on the current, employment discrimination has become increasingly prominent. Employment discrimination is the use of the work has nothing to do with the conditions of deprivation or damage to the employment of specific personnel will be fair treatment. Its not only violates the citizen's equal right to employment, but also damages the social justice.Employment discrimination is not only a legal issue, but also an economic issue.So, this article discusses the employment discrimination from the law and economics.This paper is divided into six parts: namely introduction, employment discrimination and information incomplete, the prohibition of discrimination in employment and information completely, outside the forbidden survey of employment discrimination law, perfect the prohibition of discrimination in employment law system to eliminate the employment discrimination and the conclusion. In the first chapter, the paper mainly discusses the economic model of employment discrimination and its evaluation, and then puts forward the conclusion that the nature of the employment discrimination is the incomplete information. The second chapter mainly discusses the economic analysis of employment discrimination, and then points out that information is the only way to prohibit employment discrimination.The third chapter mainly introduces the content of the legal system of prohibiting employment discrimination in the United States and the Enlightenment from the analysis. In the fourth chapter, on the basis of analyzing the current situation of employment discrimination in our country, this part puts forward the suggestion of perfecting the legal system of employment discrimination in our country. The conclusion part mainly points out the deficiency of this paper.This paper adopts the research methods of law and economics analysis to the information in the information economics incomplete theory to analysis of the problem of employment discrimination is proposed introduction of employment discrimination on the judicial interpretation, set up prohibit employment discrimination law implementation of the specialized agencies and the state construction employment equity data systems achieve complete information aspects consummates our country to prohibit the employment discrimination law is proposed.
