The Basic Theory And Application Research On Behavioral Evidence Analysis

In the field of criminal profiling deductive thinking and inductive thinking are two ways of thinking, the representative of the former is forensic scientists Brent E. Turvey on behalf of the latter is Douglas. It is mainly to analyze the behavior evidence in the way of deductive thinking, but the induction and application of the characteristics of similar cases. Deductive thinking is from the general to the specific, and the overall conclusion pays attention to the personality characteristics of case analysis without depending on previous similar cases' feature data, in which the logic is more dependent on the reappearance of crime and deep analysis of behavioral evidence. Behavioral evidence is the term put by Turvey in order to describe a series of features of the criminal from the model of behavior which refers to any evidence that helps to describe the way of crime. By analyzing the behavioral evidence left on the scene of the crime, and combining with other relevant evidences we can speculate the model the behavior of the criminal and excavate the personality, individuality and psychological characteristics of the criminal, and this way of analysis gets rid of the vulnerability of inductive thinking, improving the accuracy of locking the criminal, but its degree of difficulty is high relatively and there are large demands on the analysis of the main occupation quality and knowledge structure and comprehensive analysis ability. In the practice of investigation, it is not necessary to exclude the application of inductive thinking and it is often combined with induction with different primary and secondary. In this paper, the combination of this point of view is also discussed.Behavioral evidence analysis method has also become a emerging research direction of investigation in the academic circles as a emerging technology of criminal profiling, because of which has the distinctive investigation measures, and this is the research direction of this paper, in which the behavioral evidence analysis will be discussed from the angle of investigation, expounding the behavioral evidence analysis method based on the deductive thinking from the discussion of the basic theory of behavioral evidence analysis such as basic concept, category and logic methods, and exploring its formation mechanism and its application in the practice of investigation which is discussed in more details.This paper is divided into five parts, the full text of which has about thirty-three thousand words.The first part is a basic overview of the analysis of behavioral evidence. First of all, it introduces the status quo at home and abroad, and then focuses on the basis of thinking of behavioral evidence analysis. Finally, it expounds the significance of the analysis in the practice of criminal investigation.The second part elaborates the forming mechanism of behavior evidence and its application carrier. From the point of view of criminal behavior and criminal psychology, this paper expounds the formation of behavioral evidence in the process of crime, and discusses the application carrier.The third part is the perfection of the basic theory of behavioral evidence analysis. At first, we put forward the current research on behavioral evidence, and then we should improve the basic theory of behavioral evidence analysis from the concept and characteristics of behavioral evidence.The fourth part focuses on the application of behavioral evidence analysis in the practice of criminal investigation. This part which is the longest and the most important in this paper mainly discusses how to analyze the information of the criminal according to the behavioral evidence.This part illustrates the basic work and steps before applying the behavioral evidence analysis into investigation practice, using wholly "assessment of risk", "dynamic analysis of the evidence", "evidence holistic analysis", "mapping analysis of evidence" as the logical framework.The fifth part introduces the existing problems of the application of behavioral evidence analysis in our country investigation currently, which includes the lack of the index system of criminal behavior, the lack of legal status of behavioral evidence, and the low quality of the main detection, and puts forward the corresponding suggestions of development direction.
