A Study On The Patent Protection Tactics Of Chinese CCS Technology

Global warming is an indisputable fact, persistent smog cover most parts of China, pursuit of green low-carbon economy for going sustainability way has become urgent in recent years, China is rich in coal resources, faced with economic restructuring. carbon capture and storage technology(CCS technology) is an important strategic choice of China to solve the problem of climate change for China’s in actual conditions and energy structure at this stage, China will also become the largest potential market of CCS technology, China attaches great importance to the development of CCS technology from the 10 th Five-Year Plan, theoretical research /R & D and technology demonstration project activities gradually increasing on China’s CCS technology, Under the background of global CCS ascendant, we use comparative research methods and statistical analysis to study the Chinese CCS technology patent activities, and get the following conclusions:(1) by way of comparative study, compared patent protection of the environment between the United States and Chinese, considered that although Chinese CCS technology have strong development benefit from the support of government policies in recent years, the United States provide reference value to the patent protection of the environment,including aspects of relevant legislation, capital investment, low-carbon policies;(2) Establishing the expression of CCS retrieval on innography patent retrieval platform,obtained patent data of Chinese and US, With the method of quantitative research of carbon capture and storage technology patents(in combination with comparative study), and with the method of patent qualitative analysis, we learn the advantages and disadvantages of CCS technology patent activity, consider that development of CCS technology showed rapid in recent years,technological innovation is active, quantity of patent application is volume, but lack of core basic patents, patent layout late, weak competitiveness of enterprises patents, the technology competition of CCS technology at this stage in disadvantage.(3)Giving comprehensive analysis of Chinese CCS technology patent protection environment and patent activities, the patent protection strategy of Chinese CCS technology as follow : Conducting a strategic patent layout and management; Strengthening independent research and development, paying attention to the field of B01D053/02,B01D053/22 and carbon sequestration, Attaching great importance to patent quantity and quality; Breaking situation of patent application mainly come from scientific research institutions and large enterpri ses, strengthening the support of small and medium enterprises in R & D and patent applications, Formulating relevant standards and specification in the process of CCS technology application, meanwhile,introducing private funds, in order to enhance the capacity of technological innovation and patent-production, accelerating the introduction of supporting Patent Policy.
