In a modern democracy nation, The government's unreasonable decisions often infringe citizen's personal rights.We can see that even the constitutional government also can't guarantee citizens'basic rights fully,the majority principle sometimes is not necessarily reasonable.In the western political practice,the government's unjust behaviors can lead to civil disobedience,this is determined by the western society unique view on rights.With the development of modern democratic society, the connotation of civil disobedience is enriched, Dworkin's thought about civil disobedience is founded on this basement by solving the society events and reacting to the other points of view.His thought mainly focus on proving the legitimacy of civil disobedience action,elaborating the civil action strategy on the basis of demonstrating the legitimacy of noncompliance behavior.He thought the conditions of civil disobedience is that the citizens shall have the moral rights to strongly against the government,so the citizens can take action at the time when the legal validity is questionable.The goal of citizens to act according to the conscience and the pursuit of justice provides a good reason for this noncompliance behavior.The government must take cautious and tolerant attitude when facing such civil disobedience,this is because that this kind nonconformists is different from general offender,so the government need to treat them with respect and tolerance,and the government can protect the moral rights of the nonconformists by modifying a policy or a law.In a word, Dworkin's thought about civil disobedience mainly focuses on the issues of concrete actions, his thought shows a balance between civil rights and government power.we need to grasp his civil disobedience thought from the overall point,in this way we can better understand his theory.Dworkin's thought of civil disobedience has important theoretical value and realistic social value,it can shape the modern citizens consciousness better,guide the political practice and promote social fairness and justice.
