Studies On The Usufruct On Movable Property

The legal relation of usufruct is a legal product which solves the resource scarcity and realizes the maximum property benefit and meets the demand of proper resource allocation.At present,the system in China has only been established conceptually and the specific establishment and categorization of the system has not been finished.The author thinks that the intension of legislator is not limited to the current situation of “empty shell of concept”,but to provide the new legal tool and new platform for more subjects to take advantage of the resources from a multidirectional,multi-dimension and multilevel perspective.It emphasizes the new development of traditional property law theory at current situation.The reason why the usufructuary right of movable property has no specific right statement form is that the lawmaker is based on reasons like immature theory of this kind of right statement form.However,the “blank” in the content of property laws not depends on “deviation” of stipulated in the property laws.This paper starts from the development background of usufructuary right on personal property and the traceability of historical origins and analysises the feasibility and necessity of this system Finally we propose our personal opinions from the aspect of legislation perfection,including the scope of application of usufructuary right on personal property,the means of publicity,specific changes in the rules,this opinion under make contribution to the supplement and construction of usufructuary right system on personal property,it carry out the bold preference and imagination in system's design,which is s a very meaningful research direction.
