Research On The Unified Registration System Of Real Right Of Movable Property

For a long time,real estate,as a symbol of people's wealth,has been in a dominant position in the financing market.With the arrival of the era of large-scale industrial production,the value of movable property is gradually increasing,coupled with the real estate financing potential is approaching the limit,movable property began to be valued by people,become the emerging force of market financing.The combination of movable property and market is inseparable from the basic guarantee of registration publicity.However,due to the confusion of the current registration system in China,it is difficult to unify the registration organs and procedures,resulting in numerous loopholes.Faced with this situation,many scholars proposed to change the chaotic situation of chattel registration by realizing the unification of chattel registration system.Based on the theoretical significance of the registration of chattel's real right and the practical value of chattel's real right,this paper makes an in-depth analysis of the current registration system of chattel's real right in China,and discusses the necessity of establishing the unified registration system of chattel's real right.The main body of this paper consists of four chapters: chapter one,practical research.This chapter,by sorting out the current registration system of real right of movable property in China,puts forward the dilemma of the current registration system of real right of movable property in China and the reasons for the dilemma,in order to clarify the current practice needs of the unified registration of real right of movable property in China.Chapter two,theoretical analysis.This chapter,from the perspective of chattel real right theory and national governance theory,discusses the importance of the unified registration of chattel real right to improve the chattel ownership protection,chattel real right publicity,as well as the significance of optimizing the business environment and promoting the reform of the big-ministry system.Chapter three,feasibility analysis.This chapter analyzes the feasibility of the construction of the unified registration system of chattel's real right from three aspects: the legislative trend of the registration of chattel's real right,the practical experience of the unified registration system of chattel's real right at home and abroad,and the current technological development level,and points out the realistic conditions for the construction of the unified registration system of chattel's real right.Chapter four,legislative proposals.Through the comprehensive analysis of the former three parts,should build a unified the movable property registration system of conclusion,this chapter from the legislation orientation,the entity system,application system three Angle systematically puts forward the legislative Suggestions for the construction of unified the movable property registration system,and in reference to the provisional regulations on real estate registration and other related systems,on the basis of proposed "the interim regulations on movable property registration(proposal)".
