As a common phenomenon, cheating in the exam, especially organized cheating,tends to be more and more complicated and diversified. This trend destabilizes the exam order, break the national talents recruitment and reserve mechanism, and even infringe the personal right of justice. Therefore, cheating in the exam is bound with serious social harm.To copy with exam disorder, Chinese government enforced(Amendment to the Criminal Law of the People's Republic of China Nine), making organizing exam cheating a crime, as well as other three crimes related to cheating. This paper analyzes objective part of Organize Exam Cheating Crime with four sections, which are the introduction, the definition of national exams, the definition of cheating in exams stipulated by the law, the discussion of crime acts and the conclusion.The introduction section summaries the reason and harmfulness of prevalence of cheating in exams, suggesting the significance of enforcement of Amendment to the Criminal Law of the People's Republic of China Nine.The first section discusses what national exams are, defining national exams stipulated by the law. Then we propose our comprehension of law stipulation and indicate the scope of national exams, after which we suggest the role of law stipulation in cheating crime.The second section elaborates the definition of cheating, from the perspective of its concepts, characteristics, patterns and harms.The third section explains the crime act, which can be divided into the act of organizing and the act of aiding.we discuss the act of organizing and the act of aiding from the perspective of its concepts, characteristics, manifestations.The conclusion part reaffirms the standpoint of this paper and references several similar overseas regulations to enlighten future legislation direction.
