The examination is a kind of social practice activity of the human beings,in which the knowledge,ability,quality of the examinees are tested by means of a certain method according to the different purposes of the examination.Throughout the world education development,the examination is an important part of talent selection and the human resources allocation.Globally China is universally recognized as the first country to establish the national examination system and also a large country filled with the much examination experience and with the long examination culture.With the development of society,examination is not only a selection system but a kind of social system including politicals,economics and culture.The National education examination system viewed as an important part of the national education system plays a decisive role in improving the educational quality and promoting reformation.The Article 21 of the Education Law of the People’s Republic of China(Hereinafter referred to as the Education law)makes a clear regulation that “the country should implement the educational examination system”.However,the education examination is highly thought of in China today but the education examination legislation is seriously lagging behind while the existing legal system of the education examination is ranked lowly,with no special law enacted by the Standing Committee of the National People’s Congress.So we need to further study of education system on theory and practice.Only in this way can we make our legislation more and more Scientific,Authoritative and effective.And it can provide legal protection for our country educational examination.This thesis mainly is divided into four parts: the first one deals with the necessity and feasibility of the national education examination legislation,based on the analysis of the concept of the education examination.The second one is about China’s current situation and existing problems of the national education examination legislation.The third one is regarding the revelation from the education examination legislation of the USA,Britain and Japan.The forth one is on the specific countermeasure for this author to establish the legal principles,enrich the national education examination legislation,strengthen the legal supervision,etc.The fifth one is concerning the draft proposal of the Education examination Law of the People’s Republic of China(hereinafter referred to as Education examinations law)based on the systematic research,overview,comparison and evaluation of the Education examinations law at home and abroad in order to.improve the legislation for reference.
