Research On Some Problems Ofthe System Of Life Imprisonment

The sixteenth meeting of the Standing Committee of the Twelfth National People's Congress in August 29, 2015 passed the "criminal law of the People's Republic of China(nine)", for the first time to establish the system of life imprisonment. The establishment of the system for combating corruption and bribery has positive significance, also reflects our respect for human rights, the protection of human rights, the cautious application of death penalty policy. And due to the life imprisonment system in our country has just been established, the jurist of its legal nature and effect has yet to be a comprehensive understanding. The based on the provisions of the laws, combined with basic theory of law, to life imprisonment system the author explored the theory, found that the system in the presence of vague conditions of application, the judge's discretionary power is too broad, the applicable scope is too narrow, legal positioning confusion and other issues. Aiming at these problems, this paper mainly adopts semantic analysis, comparative analysis, logical reasoning and deductive inductive method, combining the national conditions of our country, to put forward opinions and suggestions on improving our life imprisonment system in. Then it affects the perfection of the life imprisonment system in our country, the function of the system of life imprisonment, and realizes the original intention of the legislators to establish the life imprisonment.
