China is currently in a period of rapid development,and has made great progress in economic construction and social transformation.The awareness of the rights of the people has been greatly improved,and the phenomenon of gender discrimination in employment has become more and more "unbearable."More and more women are choosing to use the law as a weapon to protect their legitimate rights and interests in the face of gender discrimination in employment.However,China still has many shortcomings in solving the problem of gender discrimination in employment.The imperfections of relevant legislation and judicial remedies have seriously damaged women's labor rights and interests.As the most advanced country in the world,the United States is relatively perfect in the legislation and judicial relief of anti-employment gender discrimination.The Legal System of the US anti-employment gender discrimination,help us to learn from the United States related to the concept and practices to make up for the shortcomings of our country in anti-employment gender discrimination.This article is divided into five parts:The first part sorts out the legal development of anti-employment gender discrimination in the United States.Divide its development into three stages,through the discussion of the various stages of legislation and the transformation of social concepts.The series,the development and improvement of the anti-employment sex discrimination law in the United States have been linked.The second part discusses the judgment criteria and defense reasons for gender discrimination in employment in the United States.This part mainly combines typical cases and related theories to explain the US judgment criteria for gender discrimination in employment.The third part discusses the US anti-employment gender discrimination from another dimension----active actions.Firstly discuss the legitimacy of positive actions,and secondly from the voluntary and involuntary two aspects of the application of positive actions,The purpose of the action and the review of legality are discussed.The fourth part mainly discusses the US relief of employment gender discrimination,mainly including litigation mechanism,alternative dispute resolution mechanism and equal employment committee mechanism.The applicable conditions,advantages and disadvantages of these three remedies were analyzed.The last part,firstly summarizes and summarizes the above-mentioned parts,then discusses the shortcomings of China's current anti-employment gender discrimination.Finally,it proposes perfect suggestions for anti-employment gender discrimination from the perspective of conceptual change and specific system construction.
