Research On The Legal Risk And The Regulatory Framework Of The Internet Finance

The combination of the Internet and the finance has given birth to the Internet finance,which has become an important tool for trading,paying and managing money matters.However,we start relatively late when we do some research on the Internet finance.In recently years,this research has drawn public interest.Analyzing the current situation of the Internet finance and the main types of legal risk,comparing the existing laws and regulations,consulting the practice of the foreign country and then build the basic principle of the Internet finance,which is good for the development of the Internet finance and to protect the legitimate rights of the consumers.Firstly,it will start the research from the background of the financial regulations in this paper,then to define the conception of the Internet finance from the manifestation and the power of the Internet finance.On this basis of theory,it will classify the Internet finance,which will provide foundation for the research on the legal risk of the Internet finance and the supervision mechanism.Secondly,it analyses the legal risk of Internet finance deeply and then point out that the legal risk is the brushing point and the foothold at all of the risk of the Internet finance,explaining the value and the awkwardness of the researching on the legal risk of Internet finance.Thirdly,from the view of the legal risk,to conclude the framework and the contents of the Internet finance,think about the problems of it.Fourthly,to analysis the developed country which Internet finance develop well and then find the meaningful experience from them.Last but not least,it focuses on the special issues and then discusses the abstract principle of the supervision mechanism of the Internet finance and the special design for the Internet finance.
