Measurement Of Intensity Of Jiangxi Province Plant Varieties Right Protection And Optimized Analysis

In recent years, China's seed industry is rapidly developing, and plant variety rights authorized number is rising gradually. But in the era of information sharing and resource sharing, plant variety right as a part of intellectual property rights is subjected to more and more violation. The protection intensity of plant variety right is a kind of intellectual property right protection in the field of intellectual property right, which is specially designed for the protection of plant variety right.It can reflect whether the plant variety right is protected properly. Therefore, it is significance for our country's seed industry development and fundamentally reduce plant variety rights infringement cases to estimate plant variety rights protection strength, adjust measures to local conditions of the plant variety rights protection.Based on the application and authorization data of plant variety right in Jiangxi Province, this paper analyzes the current situation of application and authorization of plant variety rights in Jiangxi province. The results showed that: first, the application volume of plant variety right in Jiangxi province showed an increasing trend, which reflected the enhancement of agricultural science and technology innovation activities.And the number of licensing is relatively small, mainly because of the low quality of R&D. Second, in Jiangxi Province, the main application subject of plant variety rights are scientific research institutions and enterprises, and the transformation of the main structure of agricultural innovation must be resolved. Third, the application of plant variety right in Jiangxi province is mainly based on field crops now. So the application of plant variety right in Jiangxi province need to increase the proportion of the application of economic crops in the future.For the protection of plant variety right,Jiangxi province has taken relevant measures to protect plant varieties right. First, Jiangxi Province opened related law enforcement training, to enhance the ability of law enforcement. Second, Jiangxi Provincial Department of agriculture promoted the protection of plant variety rights through a variety of forms. Third, promoting the development of plant variety rights made the protection and management of plant variety right more perfect. Fourth, strengthening the inspection of plant variety rights in the province improved the authenticity of the right of variety.In the Jiangxi Province, the calculation of the plant variety right's overall protection intensity is divided into two steps of the legislative strength and law enforcement strength measurement. As far as the intensity of legislation is concerned, in the GP method as the foundation, Jiang Xi Province Plant Variety Rights protection legislation intensity is obtained by estimating five indicators which are respectively on the plant variety rights protection coverage, plant variety rights protection related laws and regulations, protect the loss terms, law enforcement mechanism,plant variety rights protection duration.For the law enforcement strength, Jiangxi Province calculated weighted average value of the social legal system degree and complete legal system degree, level of economic development, public awareness of plant variety rights, the level of agricultural production, agricultural innovation enthusiasm, the plant variety rights protection law enforcement attitude of for plant variety rights protection law enforcement strength according to the plant variety rights expert score. The law enforcement intensity of Jiangxi Province which is relative to some provinces is low, so the overall intensity of the protection of plant variety rights is relatively low in Jiangxi Province.Jiangxi province needs to strengthen the protection of plant variety right to promote the implementation of the right and protect the work of the implementation of plant variety. On the one hand, Jiangxi province need promote the development of the whole industry by Strengthen the dominant position of enterprises in the agricultural innovation.On the other hand, the province should optimize the structure of new plant varieties and increase investment in R&D of economic crops. The government can enhance the ability of agricultural sustainable development in Jiangxi province by creating a good atmosphere of agricultural innovation, and improve the plant variety rights and the authority to improve enthusiasm of the related staff about the efficiency of agricultural innovation activities. At the same time, Jiangxi province also need expand the scope of protection of plant varieties to protect the plant species in Jiangxi province in the full range of resources, and put up local plant variety rights protection laws and regulations to ensure the protection of the right of the province's special characteristics of the plant. Law enforcement officer should enhance law enforcement capacity to create a good environment for law enforcement.
