The Research About Timeshare Contract

Timeshare system, as a new way to travel, has developed rapidly in abroad. Now it has gone through decades of time since it was introduced to China. The emergence of new forms of tourism to the Chinese market economy has brought new vitality, but also a large number of derived legal issues to be resolved which is a reality situation we can not ignore. Throughout the foreign legislation, timeshare legislation already has improved steadily, but our legislation on this system is still a blank. Lack of legal rules leads to problems difficult to solve in practice, but also hinders the healthy development of the system, so timeshare contract system is necessary to establish. This thesis is based on this background, we want to submit some comprehensive and effective suggestions for legislation of our timeshare contract system.This thesis is divided into three chapters. The first chapter about what is timeshare contract be, includes four parts, introducing the definition of timeshare contract, the type of timeshare contract, the features, benefits and risks of timeshare contract. As a new leisure tourism, the timeshare contract has its own characteristics, it is necessary for legislation to have a clear study about timeshare contract.The second chapter analyzes why the writer advocate to make the timeshare contract to be one type and into culture. The writer find many cases for timeshare contract's legislation from multiple angles and make a rationality justification of ownership timeshare contract, which is conflict with the existing property rights theory.The third chapter propose how our country should construct timeshare contract system based on the previous analysis. First, the writer give some constructive ideas for the legislation from the form and process and finally put forward some comprehensive suggestions of the legislation of timeshare contract, emphasis should be clear in the legislation of timeshare contract.The procedure of legal construction not be completed overnight, the road is difficult and long, but I look forward we can see the timeshare contract to run in a healthy legal environment in the near future.
