The arrival of the era of big data has been unstoppable,every individual in today's society are in the midst of a giant network of the Internet.Our activities in Internet will be traced which will be recorded by system,all the data gathered into a huge "data pool"as the "big data". Big data profoundly changed our lives,even hailed as a "new revolution",it can create enormous wealth.Big data has a wide range of applications in our social life,and plays an indispensable role in the aspect of government management,personal life and enterprise marketing.However,because of the immature technology,imperfect laws and regulations,lack of regulatory measures and legal measures supporting, the phenomenon of damaging the interest of network users emerge endlessly,which not only damage the legitimate rights of Internet users,but also hinder the development of the technology of big data.Therefore,protecting the data interest of network users from the legal level is necessary in the era of big data.In this paper,the introduction part introduces the application of big data in the social life,and analysis the network users'data as well as its interest protection issue from a general view.In the first chapter of this article " the challenge of network uesrs data protection in the era of big data ",the article emphatically analyzes the network users data interest,which also is the emphasis and difficulty in this article.This paper analyze this issue respectively from interest subject,content and relations in interest,and analysis data interest of Internet users from multiple perspectives.The place of interest exists inevitably have conflicts of interest,the network user data conflicts of interest is everywhere.This article selects the confilcts between data of freedom and personality protection, conflicts between data owners and data users, conflicts between public power and private rights this three aspects to analyze.Specific to our country, this second chapter "the legal status of network user data interests in the era of big data" focus on the legal status of our country. For network user data interests protection in our country, thsi paper states the legislation, the legal system safeguard and the legal measures, analyse its current situation and defects.According to the defects mentioned in the second chapter, the third chapter " the legal measures of protecting network user data interests in the era of big data " put forward measures.Correspond with the second chapter, the legislation, legal safeguard and the legal measures are analyzed. Legislation of the paper is divided into three angles:establishment of the choice of legislative mode, legislative principles and multi-level legal system; Legal safeguard is analyzed from the dimension of subject, including government departments, network operators, and network users; Supporting measures of legal systemwill be analysed from strengthening technology protection, strengthen self-discipline, and illustrates the standard data exchange behavior.Starting from the interest analysis of Internet users, present situation and defect, the measures, the writer is trying to simply analysis of big data era network user interests protection from legal view.
