Wartime Probation System Research

Wartime probation is a special kind of probation which was originally aimed to promote the criminal soldiers fighting enthusiasm, save the strength of the army, and to win the final victory of the war. Wartime probation plays an important role in ensuring the safety and stability of the country and safeguarding national military interests. As wartime probation plays such an important role in the judicial practice of our country, this article will provide a detailed analysis of its system. Through analyzing the characteristics, requirements, investigation and other aspects, this article finds some defects of it and offers their solutions. This article is divided into four parts:The first part:general survey of wartime probation. This is the introduction part of this article. First, it introduces the history of wartime probation's development. Then it expounds the concept and characteristics of it, on the basis of which the relationships between time probation system and probation system are stated. It can be concluded that wartime probation is a special kind of probation based on probation system. At last the significance of wartime probation is elaborated.The second part:the components of wartime probation system. This part analyzes the time elements, object elements, substantial requirements and exclude elements of wartime probation. Such elements highlight the unique characteristics of wartime probation.The third part:investigation of wartime probation system. Wartime probation is investigated theoretically from three aspects:its authority, its contents and its period. At last, the legal consequence of wartime probation is discussed. It can be concluded that there is only one legal consequence of wartime probation system, that is the revocation of original punishment.The fourth part:defects and perfection of wartime probation system, which is the most important part of this article. It discusses its defects from two aspects:legislation technology and legislation contents. It also provides the solution to promote the perfection of wartime probation system.
