The Research Of The Improvement And Application Of Civil Procuratorial System

In 2013, the revised civil procedure law made the procuratorial suggestion as the supervision mode of the civil procuratorial clearly. It ends that procuratorial organs have been taken protest single legal supervision mode, gradually formed the diversified pattern of the civil procuratorial supervision. In the future, procuratorial suggestion of supervision in the civil prosecutorial supervision work which will be perfectly justifiable. And it will play a important role in the work of civil procuratorial supervision which should not be underestimated.It is regrettable that the legal nature of the supervision of the procuratorial supervision in this amendment, the revised civil procedure law on the application scope of procuratorial suggestions did it too, but, from the overall perspective, the procuratorial suggestion is still lacking of relevant detailed legal provisions, the post adoption rate is not high, the supervision effect is not good and so on. How to construct and perfect the civil procuratorial system, implement the procuratorial suggestion system to the civil procuratorial supervision work, promote the development of the civil procuratorial supervision work, which is the current procuratorial suggestion system development and perfection of the final purpose.Based on the above considerations, this paper is divided into three parts, the center of the system of civil procuratorial recommendations, the use of comparison, analysis of the method, the system of civil procuratorial suggestions and improve the application of the problem. The first part is the basic theory of the procuratorial suggestion. This paper analyzes the characteristics and value of procuratorial supervision system, the second part analyzes the application status of the system of civil procuratorial suggestions in the practice of civil procuratorial system. And the third part is focus on improving the application of procuratorial supervision in civil procuratorial supervision. The author points out the problems in the application of the system.
