Research On The Problem Of The Duty Crime Of The Rural Primary Organization

The duty crime of rural grassroots organizations refers to the behavior of the staff of the rural grass-roots organizations to seek improper benefits or abuse of their rights and their legal rights and to be punished according to law.At present, China's agricultural population accounts for about 2/3 of the total population, so it is very important for the construction of anti corruption in rural areas. Because of the legislation on the prevention and punishment of the crime of rural grassroots organizations in the post crime prevention and punishment are not perfect, leading to many disputes in the process of legal application. In addition, the system of rural grassroots organization management system is not perfect, the relevant supervision measures are not in place, leading to a rising trend in such crimes.This paper to a District Prosecutor's office in the past five years investigating the rural grass-roots organizations of job-related crimes are analyzed, that cultural level is low, weak awareness of the law, privilege thought is serious, is the implementation of the rural basic level to organize personnel duty crime; management system,supervision mechanism is not perfect or not implemented, institutional factors of rural grass-roots organizations of job-related crimes; the defects of the relevant provisions of the criminal law and the criminal procedure law, is to the investigation and deal with the problem of the legal application of the rural grass-roots organizations in the post crimes. Finally, from the strengthening of rural grassroots organizations to manage and improve the management of rural grassroots organizations, improve the supervision system, special measures to prevent the crime, the law applies to the five aspects of the crime prevention and control measures, in order to achieve the purpose of effective prevention and punishment of such crimes.
