The Study On The Rights And Interests Protection System Of Indian Diaspora

Recently, the Indian government has protected the rights and interests of Indian Diaspora by legislation, establishing the administrative agencies and organizations, formulating a comprehensive policy etc. It constantly improved the rights and interests protection system of Indian Diaspora and has scored a remarkable achievements. Indian government from the angel of nation-state and sovereignty, and use "Diaspora" which generally recognized by the international academic community to refer to overseas Indians. This is the theoretical basis of the rights and interests protection system of Indian Diaspora. The law to protect the rights and interests of Indian Diaspora are scattered in the various department laws, including Indian Constitution, the Immigration Act of 1983, Foreign Exchange management Act, the Representation of the People Act, etc. The rights and interests protection system of Indian Diaspora involves the aspects of politics, economy, culture, etc. The main contents are Overseas Citizenship of India Scheme,protection of the right to vote for Indian Diaspora, Scholarship Programme for Diaspora Children, Direct Investment policy, and a bilateral social security agreements signed with many countries, and so on. In summary, the main features of the rights and interests protection system of Indian Diaspora are as follow: wide range of protection, comprehensive protection content,specialized management institutions for Indian Diaspora, paying attention to cultural rights protection and international cooperation. It will inspire Chinese government to update the concept of overseas Chinese and nationality; to improve the system of law; to set up special management institutions for overseas Chinese in central government; to promote overseas Chinese to identify Chinese culture; to adhere to the principle of domestic law and international law, when we legislate for overseas Chinese. This will promote the process of Chinese government legislation for protecting the rights and interests of overseas Chinese.
