Therefore, Therefore, this paper based on other scholars' researches, regarding the discovering the existing theoretical basis and practical requirements of implied license as the breakthrough point, explores the implementation in practice of the implied license system at home and abroad,and to summarize its experience and lessons, in order to put forward rationalization proposals of building scientific and perfect implied license system in our country.The paper includes four parts:The first part fully discusses the basic theory of copyright implied licensing system. This paper explores the theory foundation of the existence of implied license system from the fields of civil law and contract law, and then analyzes on the legal connotation and its evolution in the Internet environment of implied license within the territory of copyright.The second part demonstrates the legal value of the copyright implied license under the network environment. This paper demonstrates the superiority of the implied license system in the Internet environment, based on the characteristics of the propagation mode and the usage mode of the works under the network environment, the present situation to the imbalance of the interests leaded by traditional license and the cost of the problems in the process of licensing. At the same time, the paper expounds the necessity of building the implied license system under the network environment, combined with new cases in the legal practices in our country.The third part mainly analyzes the legal practice of the implied license under the network environment which happened in China and America. By analyzing typical cases in the practice of the United States, the paper sums up the implied license implementation of lessons in each domain, combined with the existing legislation and practice situation in our country, and lays the foundation build the perfect implied license system.The fourth part is to give rationalization proposals on the construction of the copyright implied license system under the network environment in our country. Based on the determination of the cognizance conditions of the implied license, the paper definite the application scope of the system and formulates the concrete application in the field of its search engine, sharing platform and the digital library.
