During the reform process, Chinese employees' status, rights and living conditions have a lot of changes. Under the background that strong capital and weak labor, in order to maintain and improve employees' status and rights, satisfy their material and spiritual life, promote long-term and stable development of the society, we need to rethink the institution of employee participation. This article starts with the research background and definition of employee participation, introduces the institution of employee participation around the world. Analysis the motive power and structural factors influence the employee participation by Michael Poole's theory. The third part of article introduces our country ‘s employee participation include worker congress, release the information of factory, workers' representatives participate board of directors and supervisors, collective consultation and contract and reasonable proposal. A research called New Generation Migrant Laborers living conditions Report shows that workers have passion on employee participation. But there are many problems in our employee participation institution, such as unrealistic, labor unions can't perform their duties, personal authoritarianism and severe formalism. So the forth part of article proposes the mechanism of consultation between employer and employee is the choice to construct our employee participation institution. Employer and employee can consult problems equally. Through the consultation we can eliminate the contradiction between employer and employee. Analysis the questionnaire of six companies, we find the mechanism of consultation between employer and employee can avoid strike and petition, reduce employee's hostility, improve employment stability, humanize the company's management, protect employee's dignity, strengthen the legitimacy of rule. Therefore the mechanism of consultation between employer and employee is the realistic choice of our country's employee participation.
