Labor relation has been suffering dramatic changes during the establishment of the market梠riented economy and its development in the mainland of China. To compare with that under the planning economy, the labor relation under the market梠riented economy shows the characteristics of two parties being equal in format and unequal in economical power, format of contract of labor relation, balance between private interest and social interest both in conflict and in co-existence. These dramatic changes concerning labor relation require radical reform of legal system which is mainly suitable for adjustment of labor relation under the planning economy in mainland of China. China should adapt its legal system governing labor relation to new situation. Therefore, we should establish new principles of and basic system concerning adjustment of labor relation and stipulate perfect labor rights and employer抯 rights. |
