Because news media is the carrier of information dissemination and its spread and extension are essential for the media in this information society, so they complement each other and common progress, they are inseparable as a whole. News tort has become a problem that can’t be ignored in this era of quick-moving text messages Internet. News tort is the specific part in civil tort, it refers to its essence is the contradiction between the freedom of the news and the right of personality.Personality right has been more and more perfect protection in the current judicial climate, and the personality right is often win when the conflict of the right to freedom of the press and the right of personality, this reflects the tremendous progress in China in the protection of human rights. But the excessive protection of personal right and ignoring the protection of the right to freedom of the press making the news media become overcautious in transmission process and can’t play the supervisory role of the news media of the original.
