News Infringement Defenses Of Comparative Law

In recent years, lawsuits arising from news tort are increasing. They have some common points, the consequences of the news tort are serious, the victims request the high amount of damages, the objects of infringement are more personal integrity, infringement of the main violations to the more subjective mental fault, New types of lawsuits continue to emerge. Now in our country infringement legal norms relating to information scattered across the "Constitution" and the "General Rules of the Civil Law" and related judicial interpretations, and administrative rules.Currently there is no unified "Media Law" in China. The reason is that the basis on the theory and practice of the news tort is too weak, and that requires us to study the relevant information on media law and study the developed countries. The paper focused on the plea instance of news tort, mainly from the media and the nature of their own features, we also need to combine our country's fact and international general practice, so as to exert the special effect of defenses.
