However, the development of trust system and synchronization with real estate trust has many defaults,such as the trust- ordos shanty towns transformation, trust- New York City jin real estate project in Sichuan province. Now the domestic real estate trusts need to get out of this step, and what is the obstacles it faces?Around these problems, this topic will be based on reality, from the current phase of the system as the foundation, real estate investment trust, and the specificity of the relationship between law. and find out the problem in the development of real estate investment trust.Then from the problem analysis of real estate investment trust legal obstacles. By looking for the relevant comparison points and system of the foreign legislation, to analyze how to deal with similar legal obstacles, how to solve the problem and how to summarize the theoretical knowledge at domestic and abroad.The first part of the paper is a conceptual explanation and some domestic laws and regulations collection. In this part, the author hopes to study the different ways real estate works, the difference of real estate through the trust financing at home and abroad.The second part is the study of the domestic legal system of REITS. In this part, the author hopes to overview the legal system of REITS, to understand its basic framework and characteristics. And introduce the structure, combine with its laws and regulations and looking for U.S. law to the effect of REITS, and discuss the important system value.The third part, is China’s real estate investment trust system framework design, is also the final step in this paper. The author hopes to study Chinese REITS system build barriers, analyze the obstacles and its results, then point out the idea of REITS frame from system level. |
