The Research Of Counterfeit Crime Control

Counterfeit crime seriously undermined the national economic and financial order, caused direct and considerable damage to the social public,counterfeit crime control has become one of the important tasks of China.Counterfeit crime contact with the public very closely: the public interest is a direct loss by counterfeit crime, the public is the important source of information of counterfeit crime control, the public is an important medium for the illegal circulation of counterfeit crime, so it's inseparable from the active participation of the public to control the counterfeit crime. Research on this issue both has theoretical property and practical operability.This paper, by using the public participation view in governance criminology analyzed the counterfeit crime control issue, takes literature research, case analysis and comparative study as research methods to summarized the status quo of public participation in counterfeit crime governance, analyzes the existing governance model of counterfeit crime from the demands of information disclosure, legislation, decision-making and implementation and grassroots governance that public participated four levels.Through research, we found that there are some problems as follow: the information disclosure level from the government does not meet the needs of public participation, and the public participation does not reach positive interaction cycle; counterfeit crime control legislative level lack of interactive incentives mechanism of the public participation which affects the perfection of laws and regulations that against counterfeit crime; there are public participation out of control in public decision-making and implementation level which increases the difficulty of counterfeit crime governance; the public participation of grassroots governance level is inadequate in counterfeit crime so that the base of counterfeit crime governance is undermined.To solve these problems, this paper puts forward the corresponding countermeasures of counterfeit crime: gradually disclose the information oncounterfeit crime control of the government; to establish the feedback and incentive mechanism of public participation in the legislation of counterfeit crime control to expand the scope and depth of public participation; to implement the crisis management to change the public participation out of control and establish a good release mechanism of counterfeit crime information;to establish the public participation mechanism of counterfeit crime grassroots governance and to mobilize the social public to enrich the power of grassroots governance of counterfeit crime governance.
