To ensure the better execution of the new Criminal Procedure Law amended 2012, the Ministry of Public Security held a meeting in Chongqing, in which a series of innovative working and management mechanisms concern detention centers, which initiated the campaign to comprehensively innovate their management mechanisms. The establishment of new rules and regulations inevitably led to the emergence of numerous new problems. How to deal with these contradictions and problems in the course of innovation and development is what every detention center should face up to.The whole article consists of three chapters. The first chapter depicts the roles and functions of detention centers in criminal lawsuits, which are the basic of holding unconvinced criminals from the perspective of American and British law systems and continental law systems. Based on this, five functions or roles are summarized in lawsuit, namely the role of protecting litigants, the role of safe custody, role of supervision, neutral role and role of assisting criminal investigation.The second chapter describes effects of the new Criminal Procedure Law on working mechanisms of detention centers of our country. Beginning with the present working condition, this chapter gives a detailed account of vulnerabilities existing in fundamental work, then, analyzes data collected by the supervision bureau and units of the Ministry of Public Security and provincial police departments and finally, analyzes investigative units' interrogation, counsels' visits and protection of criminals' human rights. All this clearly implies that some contradictions have existed and are beginning to turn up between the implementation of the new Criminal Procedure Law and working mechanisms of detention centers.Based on the analysis of data, the third chapter suggests countermeasures and innovative mechanisms related with detention centers in our country against the background of new Criminal Procedure Law.
