As an important part of Internet financial, the third-party Internet payment industry has made rapid development in recent years with the development of electronic commerce.Third-party payment market, large-scale, capital flows frequently, involving more and more pay for the vital interests of Payment institutions, merchants and consumers. According to iResearch data, the third-party online payment transactions of China reached 11.86745 trillion yuan in 2015, an increase of 46.9%. The third party payment precipitation funds problems have become increasingly prominent, caused widespread concern in the field of financial practitioners and theorists.Electronic Commerce in China started late, the introduction of the regulations of the people 's bank of China in recent years about third party payment provisions is not comprehensive, rules are too vague, poor maneuverability, can not solve the problems caused by precipitation funds. Compared with some countries with respect to e-commerce development lag, Europe and the United States and developed countries in Asia to deal with the risk of the third party payment precipitation funds to pay the specified regulatory system more successful. The United States third party payment regulatory authorities tend to be included in the existing laws and regulations to regulate the EU regulatory authorities will make special legislation for third-party payment agencies this nascent institution.Firstly, clarify the necessity of regulating the third party payment precipitation funds, make clear the third party payment related concepts and analyzes the risk of the third party payment precipitation funds may lead, noted the problems of relevant laws and regulations in force; then, introduced some developed countries and regions precipitation funds to pay third-party regulatory experience and enlightenment to China; Finally, make recommendations to third-party payment platform precipitation funds regulation of our country on the basis of learning the supervisory system of foreign.
