Research On The Legal Issues Of Third-party Payment Precipitation Funds

The third-party payment industry is booming in our country,and the scale of precipitation funds is expanding accordingly.In this context,the legal problem of precipitation funds cannot be ignored.In order to regulate precipitation funds,the central bank has changed from the direct connection mode to the network mode,centralized storage and management of precipitation funds,and introduced a number of relevant legislation.However,there is still a lack of legislation for precipitation funds at the legal level,and a perfect legal system is needed to regulate precipitation funds.In terms of supervision,the legislation on precipitation funds is mostly "regulations" with a low level of legislation,and the supervision mechanism of precipitation funds is not perfect.There is still a vacancy in the legislation on precipitation funds.The ownership and distribution of the fruits of precipitation funds need to be clarified by law.Poor coordination among various regulatory bodies leads to insufficient coordination and low regulatory efficiency in the supervision of precipitation funds.Legislation restricts precipitation funds excessively,resulting in insufficient liquidity of precipitation funds,which is not conducive to the long-term development of the industry;In terms of the protection of users’ rights and interests,the legislation pays too much attention to the prudent supervision of precipitated funds,and pays little attention to the protection of users’ rights and interests,which is reflected in the imperfect information disclosure system of precipitated funds and the imperfect protection and relief mechanism of precipitated funds.These potential legal problems need to be solved urgently.Therefore,this thesis analyzes the current situation of legal regulation of precipitation funds,starts from a number of legal issues,and then reveals the problems and the reasons behind the problems,learns from the advanced governance experience of Europe and America,and puts forward targeted countermeasures.
