The Feasible Research On Furtherly Improve Our Country's Visa Law System

Immigration has existed since the ancient time. The early immigrants activities subject to the level of productive forces, often shows localized, regional and disorder characteristics. With the birth of a nation, immigration from a local range of natural flow gradually evolved to a common phenomenon in the international scope, and in the legal restriction. Modern capitalist mode to speed up the flow of population in western countries, the visa law system has again and again in the immigration context gradually establish and improve. In China, the Chinese dynasties have the relevant immigration management regulations, but the law and the modern sense of the visa system is far from. Since the founding of new China, through several generations of unremitting efforts, China's legal system is more complete visa. In July 1, 2013, the formal implementation of “ Exit and Entry Administration Law of the People's Republic of China”, the law to achieve the entry and exit management from “decentralized legislation” to “unified legislation” in China, further improvement and optimization of the visa system, has the sense of milepost type in the history of the development of China's visa system.Due to historical reasons, system, compared with western countries, China visa law system in the classification, standard setting, practical applications there is still a wide gap. The author combined with years of work visa practice, through theoretical research and comparative analysis, starting from the basic problem, the legal system of foreign visa system characteristics and other aspects, and put forward some perfect our visa legal system concept, with a view to our visa regulations further development to provide some reference.There are 4 parts in this thesis.Chapter 1:expound the necessity of foreigners visa law system, and analyze the nature of international immigration and entry and residence behavior.Chapter 2:introduce the advanced and superior visa law system of the United States, Canada, Australia, the European Union from the visa classification, visa support system, visa information management system, regional integration system.Chapter 3:comb the development history of China's legal system construction of China since the beginning of the visa, focuses on the change of “the People's Republic of China exit and entry management law” in the visa system.Chapter 4:the author's thinking to further improve the legal system of China's visa. Including our immigration system reform and refine the visa issuing standards, rich visa type, put forward some suggestions to perfect the alien permanent residence system etc.
