Prepaid consumption is a new consumption pattern. In this mode of consumption, the consumer will be delivered to the operator in advance. Then the operator will deduct the corresponding amount of prepaid in the provision of goods or services. This consumption pattern is accomplished by the use of prepaid cards. As a consumer certificate, prepaid card's legal nature is a contract. According to the theory of government intervention, social overall interest standard theory, as well as the theory of real justice, prepaid cards should be regulated by economic law. And because of the unequal status between consumers and operators, consumers should be inclined to protect. Therefore, it is necessary to research the legal regulation of the prepaid card from the perspective of the protection of consumers' rights and interests. From the existing cases as well as our country's legislation present situation of prepaid card, the problems in prepaid card consumption are that operators damage consumers' right to know, right of even bargain, right of security and right of privacy. Deeper problems lie in the shortage of the prepaid card supervision management, and the limitation of the right remedy. In order to solve these three problems in the legal regulation of prepaid card, it is indispensable to improve the laws and regulations for the protection of consumer rights and interests, improve the regulatory system for prepaid cards, build a clear right relief mechanism and build an effective social security system. As a result, consumers' rights and interests can be protected. Then the market order can be maintained and economic and social can be promoted.
