Investigation Report On The Supervision Of Criminal Case On File Of Yiyang City Procuratorate

The supervision of the criminal record of China's procuratorial organs to fulfill the function of legal supervision,procuratorial power,an important manifestation of the implementation of the judicial remedy procedure,plays an important role in the process of building a socialist rule of law,not only to maintain the legitimate rights of the defendant in criminal cases,but also regulate the investigation organ of criminal activities.According to the criminal procedure law and the relevant the judicial interpretation,the procuratorial organs in criminal case supervision refers to the procuratorial organs of the public security organs and procuratorial organs duty crime investigation department subject of criminal case right shall be filed or not shall supervise the filing for criminal case and the legality of activities carried out.Based on the basic theory of the supervision of the criminal record as the basis,from the perspective of empirical perspective,through the investigation of Yiyang city in Hunan province since January 2013 criminal prosecution for supervision work analysis,understand the current procuratorial organs criminal case supervision working situation and existing problems,put forward on the basis of strengthening and improving the current criminal case supervision measures.This paper firstly the introduction introduces the origin and significance of this topic,illustrates the research background,methods,explains the position and angle of view to observe and analyze problems.This article is divided into four chapters,the first chapter mainly introduced since 2013 Yiyang City criminal prosecution for supervision,including supervision on the overall situation,type regional differences,and major practices;the second chapter mainly introduces the Yiyang city procuratorate criminal case supervision problems in investigation Based on the analysis and summary of visits,found that criminal cases are difficult to find the clues of supervision in the judicial practice,investigation and verification,supervision and treatment is difficult,the duty crime case filing supervision supervision is weak,a larger gap between the five major problems;the third chapter mainly from the supervision of filing system,working mechanism,three aspects of the subjective aspects of procuratorial personnel an in-depth analysis of Yiyang city procuratorate criminal case filing supervision problems and reasons;the fourth chapter mainly from the legislative and judicial practice put forward specific measures to improve the supervision of the criminal record,in order to better promote the procuratorial supervision of criminal case filing work.
