Research On Several Issues Of The Crime Of Dangerous Driving

With the quick development of the Chinese economy and society,the population of motor vehicles and the total number of vehicle drivers are growing rapidly.Motor vehicles,which were once a “luxury” to Chinese people,have now become a “commodity of everyday use.” In the meantime,however,traffic accidents due to breach of transportation laws have also become more serious.As a result,there has been an overwhelming voice from the public for severely punishing traffic violations.Therefore,the Criminal Law Amendment(VIII)has specified the crime of dangerous driving to cover dangerous driving behaviors such as drunken driving and chase race driving;and the Criminal Law Amendment(IX)has further improved the settings of the crime of dangerous driving to add other driving types,e.g.serious surcharge and over-speed of school buses and passenger transport vehicles.This thesis gives a legislative overview of the crime of dangerous driving,home and abroad and studies the determination of the legal constitutive requirements of drunken driving,motor vehicle and road in combination with specific issues happening in practice since the entry of dangerous driving behavior into the Criminal Law.The research is aimed to reduce disputes about the legal applicability of the crime of dangerous driving and to provide advice and reference for identifying the crime of dangerous driving in juridical practice.
