A Study On The Internal Supervision System Of The Administrative And Normative Document In Fujian Province

Administrative and normative document is the basic carrier of the administrative organs which performing its statutory duties to reach the goal of economic and social management. The formulation source of the administrative and normative document is from the authority in the constitution and the law on the authorization of the administrative organ, which has the characteristics of an extensive subject of formulating, simple procedure, lower level and diversity in content. In nature, Administrative and normative document is the abstract act of administration, and it is easy to have the direct or indirect impact on the vital interests of the public. In practice, illegal and improper administrative and normative document (called the "document which has problems") is not uncommon that cause harm to the legitimate rights of the public or enterprises, and causes indirectly negative effects to the credibility and authority of the administrative organs.Obviously, it is not conducive to the rule of law government construction. Therefore, it is necessary to pay attention to the current administrative and normative document oversight present situation and the existing problems. With empirical research, comparative research and exemplifying methods, this paper focuses on the internal administrative system, relying on the view of "administrative self-control" theory and the basis of the concept of administrative and normative document, to summarize the illegal risk points of the "document which has problems", and then to analyze the recording review, regular cleaning, setting period of validity, administrative reconsideration incidental review system as the focus. In the light of the existing problems, the paper explores the internal supervision system of administrative and normative documents and proposes some improvement possible paths, supplemented by the specific practice from Fujian Province.
