Lawyer’s out of court speech reflects citizens freedom of speech is a fundamental right of citizens guaranteed by the Constitution.But lawyer’s out of court speech is different from ordinary citizens freedom of speech,it remarks there affect their reputation and image of the industry,constitute unfair competition,against the legitimate interests of the parties,misleading inciting social emotions,justice and authority of the possibility of prejudice.Lawyer’s out of court speech cases have occurred in China’s current situation can not be resolved through litigation remedies,so the regulation of lawyer’s out of court speech is particularly urgent,want in-depth article status and problems of lawyers outside of court speech,and to understand the extraterritorial provisions lawyer for court remarks,more domestic and foreign lawyer’s out of court speech provisions,to find out the character and individuality of the place,in order to find the fit our situation construction regulations,constructive remarks applied to the lawyer’s out of court speech among the rules,we hope to provide some reference for the construction of the lawyer’s out of court remarks future.This paper is divided into four parts,the first part is set aside the concept of lawyer’s out of court speech,to find the boundary of the lawyer’s out of court speech we are discussing.The second part is based on the Case of Yao Jia Xin to see lawyer’s out of court speech at present,and analysis of the current problems,as well as the provisions of the existing laws and regulations concerning lawyer’s out of speech.The third part is to find the foreign how to provide comments and trying to find out some of the comments of outside counsel court built revelation.The fourth part is to develop our lawyer’s out of court rules to do some useful exploration,give some useful reference.
