On The Termination Of The Use Of NME Methodology According To Article 15 Of China's Acceding Protocol

Developed countries,especially the US and the EU,have long been pushing China toward being a more market-based economy conforming to their own national standards,and have agreed with China in its Acceding Protocol about a 15 years' deadline for NME treatments,that is,as late as December 11,2016,these countries are obliged to accord China MES.Nevertheless,comments come about that today's China has still not fully fulfilled their respective Market Economy Standards.According China MES would cause the US and the EU huge losses in this regard.It is right in this dilemma that the TTP has found earth to grow,through which,instead of the WTO,the US can continue putting pressure upon China in fulfilling their market economy standards.This Article will be carried out according to the above logic in three parts.Part I: Complete analysis about the US and EU's obligation under China's WTO Acceding Protocol of according China MES no later than December 11,2016.The part will present their respective official attitudes in around 2001 and different flows of scholars' opinions on this specific issue.The analysis will finally show that it is the strict treaty obligation of other WTO members to terminate the use of NME methodology against Chinese products in time.Part II: Assessment on the fulfilment status of China with regard to the US and EU's market economy standards as of 2016.The assessment is majorly based on EU's five market economy criteria,detailed issues under each of these standards will be covered.The conclusion part will show that the fulfilment rate is only around 65%,and the rest are more or less problems unlikely to be solved in the short run.Part III: Based on the conclusions of the above two parts,the part will give the judgement that TPP and TTIP are serving as a recent way-out for the US and EU facing the Termination of the use of NME methodology against China.The part will also give a preliminary assessment on the possibility of joining TPP by China.
